You can establish guardianship of a child by filing papers in court. Initially, file a petition stating your interest in obtaining guardianship along with a filing fee. You'll also want to file a letter of consent from the child's parents.

A Guardianship is started by filing a petition with the Probate Court. You can obtain this form from the Probate Court office. This form is also available online. Try to include as much information as possible in the Petition to help the Judge understand why a guardian is necessary.

A: From the time that the petition for guardianship is filed, it may take up to four months for the guardianship to be granted. The amount of time depends on the proper notice to relatives and a completed investigation, by the court, as to the appropriateness of the guardianship.

The filing fee for a Guardianship is $175.00 per Petition plus $12.00 for certified Letters of Guardianship. If you are filing for two people, such as both parents, it will cost $350.00 plus $24.00 for the certified copies. If you cannot afford the filing fee, you can ask for a fee waiver.
