Assignment of Lease FAQ
What is an assignment? An agreement between the original tenant and a new tenant by which the new tenant takes over the lease of a rental unit and becomes responsible to the landlord for everything that the original tenant was responsible for. The right a party to transfer the leasehold interest to another party.
When may a person assign a lease? The right to assign is generally subject to the permission of the landlord, which cannot be unreasonably withheld.
Is the original tenant still liable under the lease? The original tenant generally is still responsible to the landlord if the new tenant doesn't live up to the lease obligations.
