Alabama Acceptance of Guardian ad Litem and Waiver of Jury Trial

Three types of guardians recognized under the Act are: Natural Guardians, Guardians appointed or declared by the court, and Testamentary guardians. Section 6 of the Act accounts for the natural guardian of the minor. Three types of natural guardians enlisted under the act include father, mother or husband.

Guardianship is a legal process used to protect individuals who are unable to care for their own well-being due to infancy, incapacity or disability. A court will appoint a legal guardian to care for an individual, known as a ward, who is in need of special protection.

There are two types of guardianships, a full guardianship and a limited guardianship.

(i) Natural Guardian - (ii) Testamentary Guardian or Guardian Appointed by will. (iii) Guardian Appointed or declared by Court. (iv) A person empowered to act as such by or under any enactment relating to any Court of Wards. v) De Facto Guardian. vi) Ad Hoc Guardian. vii) A Guardian ad litem -

A guardianship agreement is a legal document that is used to transfer the legal responsibility and care of a child to another party.In addition, guardianship agreements can be enforced by entering into a number of different legal documents.

In a limited guardianship, a person's authority is relegated only to what the order states, and no more.In a full guardianship, the guardian is given complete authority over all of the health, housing, and financial decisions for the protected person.

A partial guardian is a guardian who has only those powers set forth in the order of appointment and the letters of guardianship. In a case of partial guardianship, the wards possess some legal control over themselves.

Guardians may be of the following types : 1. Natural guardians, 2. Testamentary guardians, and 3. Guardians appointed or declared by the court.
